General Terms and Conditions (GTC)

for the rental of vacation apartments via www.manuel.homes

1. Scope These Terms and Conditions apply to all contracts concluded via the website manuel.homes between MANUEL Holiday Homes (hereinafter “Landlord”) and the guest (hereinafter “Tenant”) for the rental of vacation apartments.

2. Conclusion of Contract By booking a vacation apartment through our website, the Tenant submits a binding offer to conclude a rental agreement. The contract is formed once the Landlord confirms the booking in writing (by email).

3. Rental Property and Purpose of Use Furnished vacation apartments as described in the respective offer are rented. Subletting or transfer to third parties as well as use for purposes other than accommodation is not permitted without the Landlord’s consent.

4. Prices and Payment Terms The prices stated on the website at the time of booking apply. The total rental price is—unless otherwise agreed—payable within 5 business days after booking confirmation, but no later than before arrival. A security deposit may be charged by individual agreement.

5. Check-In and Check-Out The vacation apartment is available to the Tenant from 2:00 PM on the day of arrival and must be vacated by 11:00 AM on the day of departure. Deviations require agreement.

6. Cancellation / Withdrawal The Tenant may withdraw from the contract at any time before the start of the rental period. The decisive factor is the receipt of the cancellation notice by the Landlord. The following cancellation policy applies: – Up to 24 hours before arrival: free of charge – After that or in case of no-show: 100% of the rental price. The Landlord will endeavor to re-rent the apartment; if successful, the cancellation fee will be reduced accordingly.

7. Tenant’s Obligations / Liability The Tenant undertakes to treat the apartment and its inventory with care and to report any damage immediately. The Tenant is liable for damage caused by him/her or accompanying persons. Pets may only be brought with the Landlord’s consent. Smoking in the apartment is not permitted.

8. Landlord’s Liability The Landlord is liable only for intent and gross negligence. The Landlord assumes no liability for disruptions or failures beyond its control (e.g. power outages, internet interruptions).

9. Data Protection The Landlord collects and processes the Tenant’s personal data for the performance and execution of the contract. The privacy policy on our website applies.

10. Jurisdiction / Applicable Law German law applies. The place of jurisdiction for all disputes arising from the contractual relationship is—where legally permissible—the Local Court of Regensburg, Germany.

11. Severability Clause If individual provisions of these Terms and Conditions are invalid, the validity of the remaining provisions shall remain unaffected.
